| Top | Q: What is the EEOC? | |
A: The EEOC is the federal government agency responsible for enforcing laws that prohibit discrimination in the workplace based on race, religion, sex, national origin, color, age and disability. For more information, please visit www.eeoc.gov. |
| Top | Q: What was the case about? | |
A: EEOC alleged that SPS Temporaries, Inc., a temporary employment agency, discriminated against individuals based on their race, national origin, sex, pregnancy status, age and disability by refusing to send them on temporary job assignments. For more details, see the "Amended Complaint" on the "Case Documents" page of this website. |
| Top | Q: What are the terms of the settlement? | |
A: The settlement terms require SPS Temporaries to take steps to prevent further discrimination and establish a monetary claims fund to compensate individuals who were not sent on temporary work assignments by SPS between January 1, 1999 and November 22, 2005 for discriminatory reasons. For more details of the settlement, see the "Consent Decree" on the "Case Documents" page of this website. |
| Top | Q: How do I know if I am eligible to participate in the settlement? | |
A: If you applied for temporary employment with SPS between January 1, 1999 and November 22, 2005 and you are either Black, Hispanic, female, 40 or older, or had an actual or perceived disability, or a record of having a disability, or were pregnant, when you applied, you may be eligible to participate in the settlement. You must submit a Claim form by April 1, 2006 to be considered for a monetary award. |
| Top | Q: Will someone contact me after I submit a Claim form? | |
A: By the Fall of 2006, you should receive a letter in response to your Claim form regarding your eligibility for a monetary award. |
| Top | Q: Who will determine whether I am eligible for a monetary award? | |
A: EEOC will carefully review your Claim form and determine whether you are eligible for a monetary award. If you disagree with EEOC’s determination regarding your eligibility status, you will be able to submit an objection to EEOC and the Court. The Court will make the final decision on any objections that are submitted. |
| Top | Q: What will the amounts of the monetary awards be and when will they be distributed? | |
A: The amount of the monetary awards is unknown at this time and will depend on how many eligible claimants submit claim forms. Under the terms of the settlement, the monetary awards will be distributed in two installments - the first in about November 2007 and the second in about November 2009. |
